Episode 0356 - The Complexity:

``Jota: This is an informal meeting to see if we can come up with a possible solution to the dilemma we are in over this huge contract and how it could have got so out of hand. Over to Gera for the main epi0.

``Gera: The builders had a small contract to create another Parki on the south east side of the centre, which was agreed upon, but again never put into writing. Shortly afterwards the Oligarchy offer them another bigger project, which they too accepted. However the contractors went ahead with the development, but they hit snags and the plans were wrong, which meant there were delays which incurred monetary funds. The planners used it as a scapegoat, to go bankrupt and out of business to hide their errors. The Contractors are saying, that it was not their fault and as the Planners have ceased trading and disappeared, then they are entitled to sue us, as a third party.

``Vanna: What happened to the contractors? ``Udal: They went out of business and they have lost a lot of investment money, which is why they will not give in, as they had to put up security to keep them a float from going under for the next 100 years. ``Qualla: All I could find is some paperwork initially offering them the contract. ``Leila: What are they saying on what was the verbal agreement? ``Qualla: They were given a free reign to do what was needed. ``Udal: That sounds fishy to me, because the bill could have been ambiguous. ``Scotty: That should have been controlled by the planners. ``Zola: How many Beings were on their board, and were they all qualified? ``Qualla: I am not sure, but I will find out right now. --- Three board members, and they are all qualified. ``Scotty: That means it is negligence on their part! ``Gera: I like it so far, but that is not enough in weight. ``Vanna: Qualla, do a cross check of their skills to the projects they were on. ``Qualla: Hang on --- Management skills, technical drafts person and builder. They were to build a new leisure Complex, and it was under construction. However the new inspectors turned up and condemned the building and it had to be demolished. ``Scotty: So no one noticed the errors? ``Leila: Who employs the Inspectors? ``Udal We do. ``Leila: So what happened to the old Inspectors? ``Udal: We do not know and they were on an independent contract basis. ``Vanna: What about their liability insurance? ``Udal: We could pursue that route, but it is tedious way to go, and would not cover their claim.

``Leila: The way I see it, is this! They had the skills to check the plans, but they let the planners do it all without question. The planners got it all wrong, but no one spotted it, until the new Inspectors came along. Although the old Inspectors were not involved, as this was a new project. Therefore both are negligent as it is both their responsibility to do progress checks. Especially as the technical planner was qualified. Therefore if you cite us as third party, we will issue a counter claim against yourselves. ``Gera: I like it. ``Udal: So do I. ``Jota: It does sound feasible. ``Vanna: You may have to pay them some compensation to keep them quiet! ``Udal: That is acceptable. ``Scotty: That could end up a stale mate. ``Leila: That is the idea, so we can keep it out of court, but as Zola implied, we would have to clear their debts off. ``Udal: Under these sets circumstances I would be willing to agree to that.

``Vanna: How do we procede? ``Jota: I like the outcome of your last trick getting them light-headed, but that will not work this time. ``Vanna: A meeting in the conference Centre, with just, croak beans and rock cakes. Late afternoon so they are tired, say at 16th time, wanting to go home. ``Jota: Nice one. ``Vanna: We will all go so they will be out-numbered 8 to 4. With a positive response from us at all times, we can lead them on, because they will like it. When we come to a dead end! Udal can offer to settle their costs. ``Gera: I think it is a brilliant idea. ``Jota: All in favour? --- Approved. I will arrange a meeting with them to discuss their complaint and leave it at that. ``Vanna: Agreed.

Udal: Headaches.
